San Marcos Council Member Faces Third-Degree Felony Charge After Alleged Biting Incident in Austin

Lorenzo Gonzalez, a sitting member of the San Marcos City Council, has been formally charged with a third-degree felony following an altercation in downtown Austin during which authorities say he bit a security guard. The arrest comes in the wake of a physical disturbance outside a downtown dining and entertainment establishment over the weekend, according to law enforcement records filed in Travis County.

The 38-year-old municipal official is facing a charge of assault on a public servant, an offense that carries significant legal and political ramifications under Texas law. According to charging documents and an arrest affidavit compiled by the Austin Police Department, the violent confrontation unfolded as uniformed security personnel attempted to manage an unrelated disturbance along a bustling commercial corridor.

Police units were initially dispatched to the 301 block of Lavaca Street in downtown Austin after emergency dispatchers received reports regarding a physical disturbance taking place outside a restaurant. While the sworn affidavit does not explicitly name the specific dining establishment involved, public records maintained in the Austin Police Department’s incident tracking database show that officers responded to a designated "assault with injury" call at that precise address at approximately 6:24 p.m. on Sunday.

Upon their arrival at the scene, responding officers were informed by eyewitnesses that the broader situation had actually involved two separate confrontations outside the establishment. The initial incident centered around an individual identified in police records only as Richard, who told authorities that he had been struck across the face by an unidentified assailant who quickly fled the vicinity prior to the arrival of law enforcement.

As Richard stood outside the venue conversing with security personnel regarding the preliminary physical assault, Gonzalez reportedly approached the group and initiated a verbal confrontation with the guards on duty. According to the arrest affidavit, investigative records do not establish or clarify whether Gonzalez possessed any prior acquaintance or personal relationship with either Richard or the unidentified attacker who fled the scene.

To corroborate witness statements and reconstruct the chronological sequence of events, law enforcement investigators subsequently secured and reviewed surveillance camera footage recorded by a neighboring bar. The recorded video evidence substantiated accounts that an escalating verbal argument had taken place between the elected council member and a private security guard assigned to the property.

The affidavit details that the surveillance video captured Gonzalez aggressively confronting the security worker before physically pushing the guard twice in rapid succession. In response to the physical contact, the security officer reportedly pushed Gonzalez backward in an apparent attempt to create distance and de-escalate the immediate physical confrontation.

The situation escalated further only seconds later when additional security guards moved in toward Gonzalez to assist their colleague and help manage the unfolding disturbance. It was during this secondary physical encounter that investigators allege Gonzalez bit one of the responding guards directly on the webbing located between the security worker's left thumb and index finger.

Responding Austin police officers who interviewed the victim documented physical injuries consistent with the biting allegation, noting in the affidavit that they observed a distinct puncture wound along with active bleeding on the security guard’s hand.

Law enforcement officials highlighted in the arrest documentation that the security guard was wearing a tactical security vest prominently displaying his employer's corporate name and insignia at the time of the assault. Investigators determined that the guard’s specialized attire clearly distinguished him as an authorized security officer, satisfying the statutory elements required to file a charge of felony assault on a public servant.

Following the physical altercation and subsequent police investigation at the scene, Gonzalez was taken into custody and transported to the Travis County Jail. Court records confirm that the council member was released from custody on Monday, Sept. 14, after successfully posting a court-ordered $5,000 bond.

Gonzalez, who was elected to his inaugural term representing San Marcos residents on the City Council in 2024, now faces substantial uncertainty regarding his ability to remain in public office as the criminal case proceeds through the Travis County judicial system.

The potential consequences of the criminal proceedings are particularly severe due to statutory governance rules established in the San Marcos City Charter. Under the explicit provisions of the municipal charter, any sitting council member who is convicted of a felony offense immediately forfeits their public office, creating the potential for an abrupt vacancy in city leadership should prosecutors secure a guilty verdict.

City administrators in San Marcos have largely sought to distance municipal operations from the ongoing criminal proceedings in Travis County. Nadine Cesak, a spokesperson for the city of San Marcos, noted that municipal officials have no additional substantive information to disclose regarding the arrest, explaining that the situation centers on an individual council member who was not acting in an official government capacity when the alleged conduct occurred.

In the immediate aftermath of the arrest, San Marcos Mayor Jane Hughson declined to provide public comment on Wednesday regarding the allegations facing her fellow council colleague. In addition, neither Gonzalez nor his designated criminal defense attorney, Sandra Ritz, responded to media inquiries seeking comment and clarification regarding the felony assault charge.
